01.General and Acceptance of Terms
Welcome to atar.ws (hereinafter the "Site"). Use of the Site, including all its content and services, constitutes full agreement to the terms of service detailed in this document. If you do not agree to the terms, please refrain from using the Site.
These terms apply to any individual or entity visiting the Site, contacting through it, or purchasing services through it.
02.Definitions
- "The Site" — atar.ws and all its pages, content, and services.
- "Site Operator" / "Provider" — David Mordechai, business ID 055899199, contact: 054-5-603-603, 313dav@gmail.com.
- "User" / "Visitor" / "Client" — any individual or entity browsing or using the Site.
- "The Services" — web development, design, development, optimization, and related services offered by the Provider.
- "Engagement Letter" — a written and signed document between the Provider and Client, defining the full project scope.
03.Services Offered
The Site presents information about web development services, but does not constitute a binding legal offer. Service purchase proceeds in the following stages:
- Initial scoping call — no obligation, no charge.
- Written quote — detailed and tailored to the specific project.
- Signing the engagement letter — binding for both parties before work begins. View my contract template →
- Advance payment — per the agreed payment milestones.
04.Site Usage Rules
The user agrees:
- To use the Site only for lawful purposes and not to violate Israeli or international law.
- Not to copy, reproduce, or publish content from the Site without the Provider's written permission.
- Not to submit false or misleading information, or someone else's information without their consent.
- Not to disrupt the proper operation of the Site (DoS attacks, automated scripts, etc.).
- Not to use the Site to distribute offensive, racist, or rights-infringing content.
05.Payment Terms
The prices displayed on the Site are standard market rates for the industry — a reference point only. The final price is set in the written engagement letter after the scoping call, based on the specific project scope.
Standard payment terms:
- 40% At signing — kicks off the work.
- 30% At final design approval
- 30% At final site delivery
Payment methods: bank transfer, credit card via secure payment processor, or other written arrangements. Tax invoice/receipt is issued for each payment.
A payment delay of more than 14 days may lead to work suspension and lawful interest charges.
06.Cancellations and Refunds
- Before signing the agreement — cancellation is free of charge.
- Within 7 days of signing (before substantial work begins) — full refund of the advance paid.
- After 7 days — payment is owed for work already performed, calculated by actual hours (₪400/hour unless otherwise agreed).
- Cancellation after launch — no refund is available for completed and delivered work.
07.Intellectual Property and Copyright
Content of atar.ws
All content on atar.ws (text, images, design, code, icons, slogans) is the exclusive property of the Site operator and is protected under Israeli and international copyright law.
Work performed for a client
Upon full payment of the compensation agreed in the engagement letter, the final code and design become the property of the client. The client may transfer, edit, or hand them off to another developer without restriction.
The Site operator reserves the right:
- To display the project in his portfolio, unless otherwise agreed in writing.
- To list the client in a customer list for the purpose of demonstrating experience.
- To use the knowledge and techniques developed for other future projects (general know-how, not client-specific information).
08.Confidentiality and Data Protection
All information the Site operator receives from the client (content, financial details, business strategy, customer lists) is deemed strictly confidential.
The Site operator undertakes:
- Not to disclose confidential information to third parties, except with the client's written consent or by legal requirement.
- To use the information solely for project execution.
- To sign a formal NDA at the client's request, at no additional charge.
Use of personal information collected via the Site is detailed in the Privacy Policy.
09.Limitation of Liability
The Site and all information on it are provided "as is", without express or implied warranty.
The Site operator is not liable for:
- Indirect damages, loss of profits, or any consequential damage.
- Disruptions, service interruptions, or errors on the Site.
- Actions of third parties (hosting provider, Google, payment processor, etc.).
- Business results of the built site (volume of inquiries, sales, etc.) — depends on many factors beyond the site.
Maximum liability of the Site operator for any claim will not exceed the amount paid for the specific service in the 6 months preceding the claim.
10.Force Majeure
The Site operator will not be liable for delays or non-performance arising from circumstances beyond its control, including:
- Strikes, labor disputes
- Natural disasters, wars, terror attacks
- Pandemics and health emergencies
- Internet outages at national or global scale
- Governmental or regulatory directives
11.Updates to the Terms
The Site operator may update these terms from time to time. Material changes will be published on the Site with an update date. Continued use of the Site after an update constitutes acceptance of the new terms.
12.Jurisdiction and Applicable Law
- These terms are governed by Israeli law.
- Exclusive jurisdiction is granted to the competent courts of the Jerusalem district only.
- Before turning to court, the parties will seek to resolve disputes amicably or through mediation.
